Supreme Court Grants Bail To Indrani Mukerjea In Sheena Bora Murder Case

The Supreme Court on Wednesday granted bail to Mukherjea in the murder case. Mukherjea has been in jail since her arrest in 2015.

The apex court granted her bail considering the fact that she has been in custody for 6.5 years, and that the trial is not likely to be complete soon.

A bench comprising Justices L Nageswara Rao and BR Gavai passed the order in a special leave petition filed against an order passed by the Bombay High Court in November 2021 rejecting her bail plea, according to a report by Live Law.

‘The petitioner had been in custody for 6.5 years…Taking into account the fact that petitioner was in custody for 6.5 years and even if 50% of PW is given up trial will not complete soon. We are of the considered view that the Petitioner is entitled to be released on bail subject to the satisfaction of the Trial Court in addition to the following conditions,’ the bench stated.

The Supreme Court bench also noted that the other accused in the case, Peter Mukherjea is already out on bail since February 2020.

The court allowed Indrani to be released on bail subject to all those conditions on which Peter Mukherjea was granted bail.
